1. Website Use
All content on this website, including photographs, videos, text, graphics, logos, design elements, branding, layouts, and other materials, is the property of Ivana Zabala Photography unless otherwise stated.
This content is protected under United States copyright law and may not be copied, reproduced, downloaded, screenshotted for unauthorized use, distributed, altered, published, displayed, sold, or used in any form without prior written permission.
You may view this website for personal, non-commercial purposes only.
2. Intellectual Property
All photographs, videos, digital files, edits, designs, written materials, creative direction, and other work created by Ivana Zabala Photography remain the exclusive intellectual property of the Company.
Clients may receive a limited license to use delivered images according to the terms of their signed client agreement. Unless otherwise stated in writing, images are licensed for personal use only.
Commercial use, publication, resale, alteration, advertising use, AI training use, brand use, vendor use, editorial publication, or use by third parties requires prior written permission and may require a separate commercial license.
Clients may not apply filters, additional edits, screenshots, or alterations to delivered images in a way that misrepresents the final work, unless otherwise permitted in writing.
3. Services
Ivana Zabala Photography may offer portrait, newborn, maternity, family, milestone, wedding, event, branding, editorial, content creation, artwork, album, print, wall art, and related photography services.
Service descriptions on this website are provided for informational purposes only. Availability, pricing, deliverables, timelines, locations, products, and service details may change at any time.
Final service details are confirmed through direct communication, a booking proposal, invoice, and/or signed client agreement.
4. Inquiries, Availability & Booking
Submitting an inquiry does not guarantee availability or reserve a date.
A session, event, wedding, branding project, or service date is only considered reserved once all required booking steps have been completed. These may include a signed agreement, paid retainer, completed proposal, invoice, questionnaire, or other required booking requirements.
A non-refundable retainer may be required to secure any date or service. Remaining balances must be paid according to the agreement provided at the time of booking.
Failure to complete payment, sign required documents, provide necessary information, or follow booking requirements may result in cancellation or release of the reserved date.
5. Payments
Payments may be processed through third-party payment processors or booking platforms.
By submitting payment, you agree to the terms, fees, policies, and processing practices of the applicable payment provider.
Ivana Zabala Photography is not responsible for technical issues, payment delays, processor outages, bank delays, card declines, transaction errors, or other issues caused by third-party payment platforms.
All payment schedules, retainers, balances, refunds, credits, fees, and cancellations are governed by the signed client agreement for the booked service.
6. Rescheduling & Cancellations
Rescheduling requests will be accommodated when possible and according to the terms of the signed client agreement.
Retainers are non-refundable. At the Company’s discretion, and only when permitted by the signed agreement, a retainer may be applied to a future session or service date.
Cancellations, missed appointments, late arrivals, weather-related changes, illness, venue restrictions, client delays, vendor issues, and other changes are handled according to the signed client agreement for the booked service.
7. Creative Direction & Artistic Discretion
By booking services with Ivana Zabala Photography, clients acknowledge and trust the artistic vision, professional judgment, editing style, posing direction, creative direction, and final decision-making of the photographer.
Final image selection, editing style, retouching, color treatment, cropping, gallery presentation, image quantity, and delivery format are at the discretion of the Company unless otherwise stated in the signed agreement.
Raw, unedited, duplicate, test, or rejected files are not included and will not be delivered unless specifically agreed to in writing.
8. Image Delivery & Timelines
Estimated delivery timelines may vary depending on the service, season, workload, client response time, artwork orders, lab production timelines, event complexity, or other factors.
Delivery timelines listed on this website are estimates only unless specifically guaranteed in a signed client agreement.
Client delays in selecting images, approving designs, completing payments, or responding to communication may affect final delivery timelines.
9. Artwork, Albums, Prints & Products
Printed artwork, albums, wall art, fine art prints, folio boxes, cards, keepsakes, and other physical products may be offered through Ivana Zabala Photography.
Product availability, pricing, materials, sizes, finishes, production timelines, and lab offerings may change at any time.
Because printed products are custom-made, all artwork and product orders may be final sale unless otherwise stated in writing.
Color, brightness, texture, cropping, and finish may vary between digital screens and printed products. We take care in preparing artwork, but exact screen-to-print matching cannot be guaranteed.
Production delays, shipping delays, lab issues, or vendor delays may occur and are not always within the Company’s control.
10. Client Responsibilities
Clients are responsible for providing accurate contact information, booking details, event information, addresses, timelines, participant details, and any relevant information needed to perform services.
For weddings, events, branding projects, or sessions involving venues, clients are responsible for securing permissions, permits, venue access, photography permissions, parking instructions, and any required approvals unless otherwise agreed in writing.
Clients are responsible for communicating any privacy requests, accessibility needs, sensitivities, restrictions, important family dynamics, venue rules, or special considerations before the session or event.
11. Portfolio, Marketing & Promotional Use
Use of client images for portfolio, website, social media, advertising, competitions, studio samples, printed materials, educational content, or other promotional purposes is governed by the signed client agreement and any applicable model release.
Clients who prefer that their images remain private should communicate this in writing before signing their agreement or before the session, wedding, event, or project takes place.
Privacy requests will be honored according to the terms of the signed agreement.
12. Third-Party Services & Vendors
Ivana Zabala Photography may use third-party platforms, vendors, labs, payment processors, galleries, scheduling tools, contract platforms, website tools, hosting providers, advertising platforms, analytics tools, printers, album companies, shipping providers, or other service providers.
We are not responsible for the actions, policies, technical issues, delays, outages, quality issues, shipping delays, or services of third-party vendors, venues, platforms, processors, or providers.
Links to third-party websites or platforms are provided for convenience only. We are not responsible for the content, privacy practices, terms, or security of third-party websites.

While Ivana Zabala Photography is committed to providing a thoughtful and professional experience, we do not guarantee specific poses, images, moments, expressions, weather, cooperation of children or guests, venue conditions, lighting conditions, exact image quantity, or specific outcomes unless expressly stated in a signed agreement.
For events and weddings, certain moments may be affected by timeline changes, lighting, venue rules, guest behavior, vendor delays, restrictions, or circumstances outside the Company’s control.
15. Limitation of Liability
The Company is not liable for circumstances beyond its control, including but not limited to weather conditions, illness, emergencies, venue restrictions, client delays, vendor issues, technical failures, equipment malfunction, power outages, internet outages, acts of God, travel disruptions, government restrictions, accidents, or other unforeseen events.
In the unlikely event of equipment failure, data loss, inability to perform services, service interruption, or other circumstances affecting delivery, liability is limited to the amount paid by the client for the affected service, unless otherwise stated in the signed client agreement.
The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages.
16. Separate Client Agreements
All booked services are governed by the specific client agreement signed for that service.
In the event of any conflict between these website Terms & Conditions and a signed client agreement, the signed client agreement will control.
17. Privacy
Use of this website and submission of personal information are also governed by our Privacy Policy.
By using this website, submitting forms, engaging with our services, or making payments, you acknowledge that you have reviewed our Privacy Policy.
18. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Florida.
Any disputes shall be resolved within the appropriate courts or jurisdiction in Florida, unless otherwise stated in a signed client agreement.

We reserve the right to modify or update these Terms & Conditions at any time.
